Commit Analytics, Inc. (“Commit,” “we,” “us”) provides software that swim clubs, coaches, and aquatics organizations use to run training, manage their operations, communicate with families, and collect payments.
This policy explains what personal information we handle, why, and what choices you have. It covers commitswimming.com, our web application, our mobile applications, and related services (the “Service”).
It does not cover the practices of a club that uses Commit. If you are an athlete, a parent, or a guardian, the club is responsible for deciding what information about you is entered into Commit and who can see it. Contact your club first with questions about your records.
Which role we play determines who you should contact and what rights apply.
Information a club, its coaches, its volunteers, or its families put into the Service — rosters, athlete records, results, attendance, messages, registrations, payment records — belongs to the club. The club decides what is collected and how it is used. We process it on the club's instructions to operate the Service. In privacy law terms, the club is the controller or business and we are the processor or service provider.
We are the controller for information we collect about our own customers and prospects: account registration details, subscription and billing records, support conversations, marketing contacts, and website analytics.
Commit is used by clubs to manage athlete records, including records of athletes under the age of 13. We handle that information on the club's behalf.
Clubs are responsible for providing notice to and obtaining consent from parents and guardians before entering information about a minor, including verifiable parental consent under the U.S. Children's Online Privacy Protection Act where it applies. Our Terms of Service require clubs to make that commitment to us.
An athlete has a login only if a club or a parent creates one and sends an invitation. Athletes cannot register themselves. Clubs must have parental permission before inviting an athlete under 13 to log in. Athlete access is limited — principally viewing their own information and maintaining basic profile details.
We use it only to provide the Service to the club. We do not use it to market to children or their families, we do not sell it, we do not use it to build advertising profiles, and we do not condition a child's participation on disclosing more information than is reasonably necessary.
A parent or guardian may review the information held about their child, ask for it to be corrected, ask for it to be deleted, and refuse further collection. Because the club controls this information, contact the club first. You may also contact us at team@commitswimming.com and we will route the request to the club and assist in responding, or act directly where the law requires us to.
We do not sell personal information, and we do not share it for cross-context behavioral advertising.
Where the GDPR or UK GDPR applies and we act as controller, we rely on: performance of a contract, to provide the Service and administer subscriptions; legitimate interests, to secure and improve the Service, prevent fraud, and market to business contacts; consent, for non-essential cookies and certain marketing, which you may withdraw at any time; and legal obligation, where we must retain or disclose information.
Where we act as processor for a club, the club is responsible for establishing its own legal basis.
The Service includes features that use artificial intelligence, including workout generation and assistance with onboarding and support.
Where an AI feature is trained, tuned, or personalized on data from an account, that processing happens within that account. We do not use one customer's data to train or personalize features made available to a different customer. Within a single club account, data contributed by different coaches and users of that club may be used together.
We may use third-party model providers to deliver these features. They act as our subprocessors and are contractually restricted from using the data for their own purposes.
We share personal information only as follows.
A current list of subprocessors is available on request at team@commitswimming.com.
Payments are processed by Stripe, Inc. When a club collects money through Commit, the club is the merchant of record and holds a connected account with Stripe under Stripe's own agreement. Card numbers and bank details are collected and stored by Stripe; we do not store full payment credentials.
We receive transaction metadata — amounts, dates, status, payer name and email, and payout and dispute records — in order to operate billing features and support clubs. Stripe processes personal information as an independent controller for its own compliance purposes. See Stripe's privacy policy at stripe.com/privacy.
The Service is hosted in the United States. All information, including information originating in the European Economic Area, the United Kingdom, Australia, Canada, and elsewhere, is stored and processed in the United States.
We do not offer data residency in any other country, and we cannot commit to storing or processing information outside the United States. If you use the Service from outside the United States, your information will be transferred to the United States, where privacy laws may differ from those in your country.
Where required for transfers from the EEA or the UK, we rely on the European Commission's standard contractual clauses and the UK addendum, and will enter into them on request.
We retain information for as long as an account is active and for a limited period afterward.
Backups are cycled on a rolling basis and information may persist in backups for a period after deletion from active systems.
We use cookies and similar technologies on our website and in the Service.
Where required by law, we ask for your consent before setting analytics or marketing cookies, and you can change your choices at any time through the cookie settings link on our website. We honor Global Privacy Control signals where applicable law requires.
We maintain administrative, technical, and physical safeguards appropriate to the nature of the information and the size of our organization, including encryption in transit, access controls, and logging. No system is perfectly secure and we cannot guarantee absolute security.
If we become aware of a breach affecting personal information, we will notify affected clubs without undue delay and provide the information they need to meet their own obligations.
You may ask us to access, correct, or delete information we hold about you, and you may opt out of marketing email at any time using the unsubscribe link or by contacting us. If your information was entered by a club, we will refer your request to that club and assist them in responding.
You have rights of access, rectification, erasure, restriction, portability, and objection, and the right to withdraw consent. You may complain to your local supervisory authority.
Depending on your state, you may have the right to know what personal information we collect and how we use and disclose it; to access, correct, and delete it; to opt out of sale, sharing for cross-context behavioral advertising, and certain profiling; and to be free from discrimination for exercising these rights.
We do not sell personal information and do not share it for cross-context behavioral advertising.
In the past twelve months we have collected the categories described in Section 3 — identifiers, customer records, protected classifications such as age and gender where a club enters them, internet activity, approximate geolocation, and professional information — for the purposes in Section 5, and disclosed them to the categories of recipients in Section 8.
Email team@commitswimming.com. We will verify your identity using information we already hold, respond within the time the applicable law requires, and will not charge a fee except where permitted. You may use an authorized agent with proof of authorization.
We may update this policy. If a change is material, we will give at least 14 days' notice by email to account owners, by notice within the Service, or both, before it takes effect. Where a change materially affects how we handle children's information or expands our use of customer data, we will seek affirmative acceptance from account owners rather than relying on continued use. Prior versions are available on request.
